in Florida.  Though federal law requires that such documents must be preserved for 22 months, county election officials are rendering the public blind by denying the digital records that could
produce a quick, highly reliable outcome to all major elections.

Brakey’s complex, compelling suit is almost certain to go to the US Supreme Court.  The Court’s decision in turn could determine whether there is a fair vote count this fall, and whether it is
timely and reliable, with a complete paper backup.

Such a decision would determine whether the 80% of US precincts with electronic ballot imaging machines will in fact use the digital ballot images for the critical vote count, a decision that could
in turn determine the outcome of the election.
